PERM-Based Immigration

The Program Electronic Review Management (PERM) labor certification program was implemented on March 28, 2005 by the U.S. Department of Labor as the process for submitting labor applications. This process is the procedure a U.S. employer uses to submit an Application for Permanent Employment Certification (Form ETA 9089) with the U.S. Department of Labor (DOL).

In order for an employer to obtain an approved PERM Labor Certification, they must demonstrate it attempted to try to find a qualified, willing, able, and available U.S. worker to fill the permanent full-time position it needs filled, but after testing the U.S. labor market through a service of advertisements, job postings, etc. it was not able to find a U.S. worker to fill the position.
